  2. A deposit is required per person after the online reservation is submitted.
  3. Please complete all parts of the Online Reservation Form. All fields with an *asterisk are required.
  4. Reservation Form must be submitted by the Lead Client (person responsible for the CABIN / ROOM)
  5. Once you have completed and submitted your online reservation form, the page will guide you to submit your 1st. payment.
  6. Once payment is received and cleared, you will receive a payment confirmation email.
  7. If you need a cabin for 3 or 4 passengers and received a quote already. Please submit your reservation form by Clicking Here.
  8. If you need a cabin for 3 or 4 passengers, but don’t have a quote. PLEASEClick Here to request a quote. Our blocked inventory is based on double occupancy only, but we can get you a triple or quad.

Transportation from Airport to the Cruise Terminal are provided by Royal Caribbean International From Newark, NJ airport at $27.95 per person each way and can be purchased in advance or at the airport by the baggage claim area at the same price.Prices are subject to change.

Lead Client Responsibilities

Dear Traveler,
For your information, we have included the Lead Client responsibilities below.IF you are the Lead Client of your cabin/room please make sure you get familiar with the responsibilities listed below and forward this information to the other passengers in your room.
The guest who submits an online reservation for a cabin/room will be considered that cabin’s “Lead Client” and is the “owner” of the reservation. The Lead Client is therefore solely responsible for initiating or authorizing changes to the reservation and must agree in writing to any changes made to the reservation, by emailing: rcolon@u-neeksounds.com.
​The LEAD CLIENT is not allowed to change its name within the reservation. At least one “original” and/or lead guest name must remain on the reservation. If all original guests cancel, this is considered a full cancellation and name changes will not be allowed. An original name is one that has been added to your reservation at the time of your initial deposit or payment. In all cases of name changes, the NEW guest must make full payment. Once that payment has been made, then the applicable amounts paid by the ORIGINAL guest will be refunded directly to the original guest, minus the penalties and the cost of the name change fee.

Responsibilities

  1. It is the responsibility of the Lead Client for making sure this information and all other information associated with this group are made known to all passengers in your room. This includes Passport and Visa requirements; if any.
  2. The Lead Client is responsible for making sure all information is double-checked for errors.
  3. The Lead Client is responsible for making sure they read all terms and conditions.
  4. The Lead Client is responsible for the following of payments-scheduled for their room to avoid an auto cancellation. This information is posted on your email confirmation and the group web-page.
  5. All changes or cancellations must be submitted by the Lead Client of the room and must be submitted in writing before calling our office. The request must be sent via email to rcolon@u-neeksounds.com
  6. Refund will go to the client whose money was received from. For Example; if the lead client makes a payment for all parties in the room with a personal credit or debit card with his or her name on it, the refund will go to the person whose name is on the card.

Insurance


IMPORTANT: Your 1st. non-refundable deposit of $125.00 pp and agency revision fees are not covered by the travel insurance.

Travel insurance protection CANNOT be added to your booking until we provide you with the Cruise Line’s reservation number.

IMPORTANT: ROYAL CARIBBEAN POLICY – IF AT LEAST ONE PASSENGER REQUEST THE TRAVEL PROTECTION INSURANCE TO BE ADDED TO THE BOOKING, ALL OTHER PASSENGERS IN THE STATEROOM WILL HAVE TO PURCHASE THE INSURANCE AS WELL

With the Royal Caribbean Travel Protection Program Cancellation Penalty Waiver, if your plans go awry and you cancel your cruise vacation (for specified reasons), Royal Caribbean will waive the non-refundable cancellation provision of your cruise ticket contract and pay you IN CASH the value of the unused portion of your prepaid cruise vacation.

Because our liability for loss or damage is limited by the Cruise Ticket Contract, we recommend that all guests check their own insurance coverage or consider purchasing the Royal Caribbean Travel Protection Program.

​This agreement sets forth the terms and conditions under which we, U-NEEK SOUNDS ENTERTAINMENT & U-NEEK EVENTS LLC, in return for your payment of the amounts indicated in this agreement. These documents contain important limitations on your rights. These are legally binding documents separate from the ticket contract issued by the Cruise line. By making a reservation or payment on behalf of yourself as well as the members of your group, party, or traveling companions, you agree to the Terms & Conditions on behalf of all members of your group or party and all your traveling companions. PLEASE READ CLIENTS RESPONSIBILITIES.

Terms & Conditions & Important Information

Prices are per person; based on double occupancy and include all taxes and fees. TRIPLES OR QUADS OCCUPANCY ARE AVAILABLE UPON REQUEST ONLY YOU MUST SUBMIT A QUOTE REQUEST. Single Travelers are responsible for the other half payment of their cabin. Sorry, no exceptions. NOT included in the prices are miscellaneous charges such as airfare, transfers, travel insurance, tourist visa, bar bills, laundry, room service, telephone calls, gratuities, porterage or any other incidental charges.

ONLINE RESERVATION FORM:

After submitting your reservation form the webpage will automatically guide you to make payment. Please follow the payment instructions. If payment is not received after your e-form is submitted, your stateroom will be returned to inventory and will be available to other guests. Once any payment is received, you are bound by the terms of U-Neek Entertainment, U-Neek Events, LLC, the supplier (e.g. cruise line) and the travel agency (Sun Travel Online, LLC dba My Cruise Menu).

AGE POLICY

All participants must be 21 years or older to attend.
The Cruise Line requires that all passengers be 21 years old (on embarkation day) to travel. Guests under the age of 21 must be accompanied in the same stateroom by a parent or guardian ( 21yr. or older on Royal Caribbean) (25yr or older on Carnival). Please visit the cruise lines’ website for age policy. Ages will be verified at embarkation. Passengers not conforming to this policy will be denied boarding and assessed a 100% cancellation penalty. NO exceptions will be made at embarkation. Please note that adult guests are responsible for the safety and behavior of their minor guests.

Married Couples

Two people under the age of 21 may travel together in the same stateroom if they are a married couple. Legal proof of marriage/civil union must be provided to the cruise line at least three weeks before sailing. Please provide the document to rcolon@u-neeksounds.com

CANCELLATIONS/REFUNDS (PENALTIES ARE PER PERSON) There are NO exceptions to our cancellation policies.
THE FIRST $125.00 PER PERSON (for double) and $375.00 PER PERSON (FOR TRIPLE/QUAD) IS NON-REFUNDABLE ONCE PAYMENT IS RECEIVED, THIS IS IN ADDITION TO THE CANCELLATION SCHEDULE SHOWN BELOW AND REVISION FEES OF $25.00 PER PERSON SET BY THE TRAVEL AGENCY. NO SHOWS NO REFUND.

SCHEDULED PAYMENTS & LATE PAYMENT FEE:

  • ANY PAYMENT RECEIVED 6 DAYS FROM ANY OF THE SCHEDULED DATES LISTED ON THE EZ PAYMENTS’ PAGE WILL INCUR A LATE PAYMENT FEE OF $20 PER CABIN. THIS FEE WILL BE ADDED TO YOUR RESERVATION.
  • ON THE 10TH DAY, IF NO PAYMENT IS RECEIVED, YOUR CABIN WILL BE CANCELED FOR NON-PAYMENT AND WILL BE SUBJECT TO THE PENALTIES IMPOSED AT THIS TIME.
  • GRACE PERIOD INCLUDE SATURDAY AND SUNDAY.

CHANGES TO YOUR RESERVATION & FEES: Name Changes are considered a cancellation And AT THE DISCRETION OF THE TRAVEL AGENCY AND THE SUPPLIER (e.g. CRUISE LINE). See the cancellation/refunds information above. REPLACING BOTH NAMES OR ALL ORIGINAL NAMES IN THE CABIN/ROOM WILL CANCEL OUT YOUR CABIN ENTIRELY. Read The LEAD CLIENT is not allowed details below.

REVISION FEES: A fee of $25.00 per person and/or per room will apply. This fee is in addition to the non-refundable payment and cancellation schedule shown above. All changes are done at the discretion of the travel agency and the supplier (e.g. cruise line).

  • Changes in occupancy will result in a rate change depending on the type of change – $25.00 per change.
  • Changing a name – $25.00 per person.
  • Changing cabin number $25.00 per change.

AIRFARE INFORMATION:

The client is responsible for his/her Airfare unless Air is purchased with the cruise line or with an Air & Hotel Package (contact our office). Make sure you get an early “morning” flight. And on your return flight, do not get a flight before 1 pm. Remember, you need time to get off the ship, and you need to be at the airport at least 2hr. before your departure time.
PROOF OF IDENTITY / CITIZENSHIP: Guests are responsible for traveling with proper documentation – we strongly recommend that all of our guests travel with a passport at least valid for 6 most after travel, proof of required immunizations & visa(s) & proof of eligibility to enter international countries (for applicable itineraries). Having a valid passport will enable you to fly from the U.S. to a foreign port in the event you miss your scheduled embarkation, or to fly back to the U.S. should you need to disembark the ship mid-cruise for any reason. For security reasons, first and last names must match the government-issued ID used for boarding. For guests with spelling errors or name changes, this may result in a higher fare, loss of space and/or change fees. It is the responsibility of the client to make sure that the name/names on the reservation are an exact match to proof of citizenship as follows. IMPORTANT: Baptismal papers and hospital certificates of birth are not acceptable. Voter registration cards or Social Security cards are not considered proof of citizenship. If you are not a U.S. Citizen, please contact U.S. Immigrations at 1-800-375-5283 to be sure your identification will be satisfactory for both entries into the U.S., and the cruise.
TRAVEL INSURANCE IS HIGHLY RECOMMENDED. It is the sole responsibility of the passenger to purchase Travel/Cancellation insurance. The travel agency has travel insurance protection available for purchase including trip cancellation, baggage, flight, and accident insurance. If for any reason any of our travel insurance suppliers do not cover the state or country of your residence, or we (U-Neek Events, LLC/U-Neek Sounds Entertainment/Sun Travel Online, LLC or the Cruise Line) are not able to provide you with travel insurance, it is still your responsibility to research and purchase Travel/Cancellation Insurance. Certain pre-existing conditions may be excluded. The exact coverage provided is specific to the insurance carrier selected. INSURANCE payments received are NON-REFUNDABLE. Payment for the plan may not be accepted after the Cruise Vacation cost has been paid in full. WARNING: YOUR 1ST. NON-REFUNDABLE DEPOSIT OF $125.00 PER PERSON & REVISION FEES ARE NOT COVER BY TRAVEL INSURANCE.
IMPORTANT – Fuel Supplement: Royal Caribbean International reserves the right to impose a fuel supplement on all guests if the price of West Texas Intermediate fuel exceeds $65.00 per barrel. The fuel supplement for 1st and 2nd guests would be no more than $10 per guest per day, to a maximum of $140 per cruise; and for additional guests would be no more than $5 per person per day, to a maximum of $70 per cruise.
CRUISE REMOVE FROM PUBLIC SALE – The Cruise Line reserves the right to unilaterally withdraw any sailing from public sale, with or without prior notice (e.g., if the Cruise Line elects to charter the vessel). In that event, the cruise line will provide the agency (Sun Travel Online, LLC) with reasonable alternatives and will otherwise work with us to address issues caused by the withdrawal. If the Cruise Line, the Agency (Sun Travel Online, LLC/My Cruise Menu) & U-Neek Events, LLC are unable to agree on an alternative sailing, the Cruise Line will refund all amounts received under this agreement in which event the Agency (Sun Travel Online, LLC), U-Neek Events, LLC or the Cruise Line will have further rights or obligations under this agreement.

RIGHT TO CHANGE ITINERARY

U-NEEK EVENTS LLC, U-NEEK SOUNDS ENTERTAINMENT AND/OR THE CRUISE LINE, reserve the right, at any time, to change the cruise itinerary whenever advisable or necessary. In this case, U-NEEK EVENTS LLC, U-NEEK SOUNDS ENTERTAINMENT AND/OR THE CRUISE LINE, will NOT be responsible for any loss or expenses caused because of such changes or abandonment. Refunds will NOT be made to passengers who elect not to complete the cruise for any reason or cause whatsoever.

CANCELLATION OF U-NEEK EVENTS ARTIST/EVENTS/CONTRACTORS

U-NEEK EVENTS LLC / U-NEEK SOUNDS ENTERTAINMENT has entered into an agreement with each performing artist on the Cruise to be present on board the Cruise or in the islands and to perform under terms specified therein. However, neither U-NEEK EVENTS LLC nor THE CRUISE LINE, NOR THE TRAVEL AGENCY (SUN TRAVEL ONLINE LLC/MY CRUISE MENU) shall be liable or responsible for the failure of any artist, DJ, musician or contractor to appear on board or to perform or provide their services under his or her agreement. Further, neither U-NEEK EVENTS LLC nor THE CRUISE LINE, NOR THE TRAVEL AGENCY (SUN TRAVEL ONLINE LLC/MY CRUISE MENU) shall be liable or responsible for any loss, damage, cost, or expense of any kind to any Passenger or any other person or entity in the event that such performance or service is prevented or such loss, damage, cost, or expense is caused by or results directly or indirectly from any act of God, war, fire, collision, directions of underwriters, arrest, order or restraint by any government agency or official acting under color of authority, acts of terrorism, labor disturbances or disputes, civil commotion, weather conditions and considerations of the safety of the vessel (for which the Master shall be the sole judge), breakdowns of or damage to the vessel’s hull or machinery, requisition of the vessel by governmental authority, illness, death of a family member or other cause or circumstance beyond U-NEEK EVENTS LLC or THE CRUISE LINE, or THE TRAVEL AGENCY (SUN TRAVEL ONLINE LLC/MY CRUISE MENU) control. In the event of any failure of contracted artists to perform/service during the cruise, U-Neek Events, LLC, in its sole discretion, may engage a replacement artist or artists or service or may change, postpone or terminate all or any part of the Cruise or the entertainment program or change the program or itinerary. In such a case, U-Neek Events, LLC, shall have no liability to any Passenger for any loss, damage, cost or expense whatsoever because of such change.

CANCELLATION OF U-NEEK EVENTS BY U-NEEK SOUNDS ENTERTAINMENT AND/OR THE CRUISE LINE

In the event of strike, lockouts, riots or stoppage of labor from whatever causes, or for any other reason whatsoever beyond the control of U-NEEK EVENTS LLC, THE CRUISE LINE, THE TRAVEL AGENCY (SUN TRAVEL ONLINE LLC/MY CRUISE MENU), the Cruise Line in its sole discretion may cancel, advance, or postpone any scheduled sailing or call at any port and may (but is not obligated to) substitute another vessel, and neither the Cruise Line nor U-NEEK EVENTS LLC nor THE CRUISE LINE, NOR THE TRAVEL AGENCY (SUN TRAVEL ONLINE LLC/MY CRUISE MENU)shall be liable for any loss whats so ever to passengers by reason of such cancellation, advancement, postponement, or substitution. Thereupon, U-NEEK EVENTS LLC, NOR THE TRAVEL AGENCY (SUN TRAVEL ONLINE LLC/MY CRUISE MENU) shall return to you, if the Cruise is completely canceled, your cabin fare, prepaid gratuities, cruise line transfers and related taxes and fees, or, if the Cruise is partially canceled, a proportionate part thereof. Under such circumstances, U-NEEK EVENTS LLC, NOR THE TRAVEL AGENCY (SUN TRAVEL ONLINE LLC/MY CRUISE MENU) shall have no further liability for damages or compensation of any kind. Please note that the availability of any refund for travel insurance and/or other travel products (airfare, hotel, car rental), even if purchased in conjunction with the Cruise, will be determined under the applicable cancellation policies for such other products or services.

SAFETY WHILE IN PORTS OF CALL AND ONBOARD THE VESSEL

You assume sole responsibility for your safety on board and in any port of call. U-NEEK EVENTS LLC OR THE TRAVEL AGENCY (SUN TRAVEL ONLINE LLC/MY CRUISE MENU) does not guarantee your safety at any time. You may find information about the scheduled ports of call through the U.S. Department of State, Centers for Disease Control and Prevention and other governmental and tourist organizations. U-NEEK EVENTS LLC, OR THE TRAVEL AGENCY (SUN TRAVEL ONLINE LLC/MY CRUISE MENU) and the other Released Parties assume no responsibility for gathering and/or disseminating any such information. You acknowledge that all shore excursions and tours, however, conducted, airline flights and ground transportation, and any ship physician, nurse and onboard concessions (including, without limitation, gift shops, spa, beauty salon, fitness center, golf and art programs, and video/snorkel concession) are operated by independent contractors. U-NEEK EVENTS LLC OR THE TRAVEL AGENCY (SUN TRAVEL ONLINE LLC/MY CRUISE MENU) neither supervises nor controls their actions, nor makes any representation, whether express or implied, as to their suitability. These services are provided only as a convenience for you, and you are free to use or not use them. You agree that U-NEEK EVENTS LLC OR THE TRAVEL AGENCY (SUN TRAVEL ONLINE LLC/MY CRUISE MENU) assumes no responsibility, does not guarantee performance and in no event shall be liable for any negligent or intentional acts or omissions, loss, damage, injury or delay to you and/or your property in connection with these services. You use them at your own risk.

INOCULATION & HEALTH

All guests must ensure that they are medically and physically fit for travel. The Centers for Disease Control (CDC) and the World Health Organization (WHO) provide guidelines as to which vaccinations are required in each country. In many cases, inoculations are recommended but in some circumstances, they are required. We recommend that you check with your health care professional or a Travel Medicine Specialist certified by the WHO for guidance. Other informational resources can be accessed at the Center for Disease Control and Prevention’s Traveler’s Health website or toll-free at 1-877-FYI-TRIP, and the World Health Organization website.

PASSENGERS WITH SPECIAL NEEDS

By submitting your reservation, you warrant that you, and those traveling with you, are physically fit to travel at the time of embarkation. Boarding will be denied to any person who will enter her third trimester (twenty-seventh week) of pregnancy by the time of the Cruise sailing date or during the cruise and to infants under four months old. You must notify U-NEEK EVENTS, LLC at the time of booking of any disability or other medical or physical condition that may require special assistance during the Cruise. Your failure to do so will release U-NEEK EVENTS, LLC from any liability for loss, damages or other compensation arising from or related in any way to such disability or condition. U-NEEK EVENTS, LLC, and SUN TRAVEL ONLINE, LLC (travel agency) and the Cruise Line reserve the right to require that any passenger who is not self-sufficient travel with a companion who shall take responsibility for any assistance needed during the Cruise and in case of emergency.

DISCLAIMER

U-Neek Events, LLC/U-Neek Sounds Entertainment acts only as a sales and marketing agent to book travel arrangements using the services of Sun Travel Online, LLC (travel agency) on the Cruise Line and various suppliers. U-Neek Events, LLC expressly disclaims any responsibility for personal injury, property damage, loss, delay, inconvenience, or other matters due to negligence, wrongful acts, errors or omissions on the part of any third party, or any supplier of services of goods. Participation on the Cruise may be denied to any person who, in U-Neek Events, LLC’s or the Cruise Line sole discretion: (1) is or becomes in such a condition as to be unfit to travel; (2) is dangerous or obnoxious to others; or (3) is inadmissible under the laws of any country of debarkation. Also, U-Neek Events, LLC and the Cruise Line reserve the right to refuse passage, disembark or confine to a stateroom any person whose physical or mental condition or behavior they consider, in their sole discretion, to constitute a risk to the person’s well-being or that of any other person. U-Neek Events, LLC nor Sun Travel Online, LLC (travel agency) shall have no liability to any such person or any third party arising out of any such decision. Any costs resulting from U-Neek Events, LLC’s and/or the Cruise Line’ decision, including, without limitation, costs of lodging and transportation, shall be the responsibility solely of the person.

CRUISE TICKET CONTRACT

You will receive the Cruise Line Standard Contract of Passage Terms and Conditions with your Cruise ticket. The Cruise Line Contract constitutes your agreement with the Cruise Line. The Cruise Line Contract provides that the Cruise Line may exercise its rights in a variety of matters, including, without limitation: Its right to alter the ship’s course, ports of call, itinerary, activity and shore excursions, for reasons set forth therein. U-Neek Events, LLC & Sun Travel Online, LLC (travel agency) shall not be liable to you or any third party for any claim or cause of action arising, directly or indirectly, in whole or in part, out of the Cruise Line exercise of any of its rights as provided in the Cruise Line Terms. Without limiting the foregoing, the Released Parties such as U-Neek Events, LLC & Sun Travel Online, LLC (travel agency) shall not be liable to any Cruise passenger for a full or partial refund of any Cruise fare, or for any lodging or transportation expenses, as a result of the Cruise Line exercise of its contractual rights.

LIQUOR & BEVERAGE POLICY

Guests are prohibited from bringing any alcoholic beverages, non-alcoholic beverages or any food onboard. Alcoholic beverages will not be sold or served to anyone under the age of 21. The cruise line reserve the right to refuse the sale of alcoholic beverages to anyone. Alcoholic beverages purchased in the ship’s gift shops or ports of call will be retained by the Cruise Line until the end of the voyage.

LUGGAGE

Each guest may bring onboard a reasonable amount of baggage. All luggage must be stored in the passenger’s cabin. Pets, dangerous or illegal items such as weapons, explosives, combustible substances, non-prescription controlled substances, or illegal drugs may not be brought on board the ship. Any such items shall be surrendered to security at embarkation and may be disposed of at the sole discretion of the Cruise Line. All luggage hand-carried or checked, and your person is subject to security inspections that may involve physical search. Curbside porters are available at the pier during embarkation to take luggage to the vessel. Please be sure each piece of luggage is locked and has a tag listing your name, ship, and stateroom number. The Cruise Line and U-Neek Events, LLC and Sun Travel Online, LLC (travel agency) assume no responsibility for carry-on luggage. Any luggage left at the pier will be forwarded at the guest’s expense. Claims for luggage loss or damage must be made in writing to debarkation personnel before leaving the pier area.

PHOTOGRAPHY/VIDEO RELEASE

Video or audio recording, filming, or photographs may occur onboard the U-Neek Events, LLC, which may be owned, licensed, assigned or distributed nationwide and worldwide by U-Neek Events, LLC, their affiliates and assignees. You hereby allow, waive and authorize U-Neek Sounds, LLC, its affiliates, and assignees the right to use your likeness in any manner whatsoever. You will not receive any compensation for such use and waive any right to bring any action in law or equity against allowing U-Neek Events, LLC, their affiliates and assignees for such use.

ZERO TOLERANCE DRUG POLICY

U-Neek Events, LLC and the Cruise Line, have a zero-tolerance policy regarding the use, possession, purchase or distribution of illegal controlled substances. Any violation of this policy will result in disembarkation from the vessel as well as the individuals being turned over to the local law enforcement officials for appropriate legal action. In such cases, U-Neek Events, LLC nor Sun Travel Online, LLC (travel agency) ​ and the cruise line shall not be liable for any refund or other compensation or damages.

NO VENDING OF ANY KIND

Unless you are a sponsor, NO VENDING OF ANY KIND IS ALLOWED during the U-Neek Events’ private functions. For information on sponsoring, please email rcolon@u-neeksounds.com Please do not make tee shirts, hats, posters, jewelry or anything else to sell while participating in U-Neek Events private functions. Anyone found in violation of this policy will have his or her unauthorized merchandise confiscated. This policy will be strictly enforced.

MEDICAL CARE

You assume all risks associated with travel and transportation on the Cruise. While at sea or in port, the availability of medical care may be limited and/or delayed. You acknowledge that all or part of the Cruise may be in areas where medical care and/or evacuation may not be available. You agree to indemnify and reimburse U-Neek Events, LLC and/or the Cruise Line in the event that either party, in its sole discretion, advance to you the cost of emergency medical care, including medical evacuation and/or medical care provided ashore, as well as transportation and/or lodging in connection therewith. U-Neek Events, LLC nor Sun Travel Online, LLC (travel agency) shall have no responsibility to advance any such costs.

CABIN ON A GUARANTEE

OUR GROUP INVENTORY is held by the travel agency on our behalf on a “Guarantee Basis Category” you agree and understand that this means that you are guaranteed a cabin (interior, window or balcony) on the cruise. It DOES NOT mean you are being promised the location and or category of the cabin. Once the amount required by the cruise line is met, the travel agency will assign a room number and location based on inventory availability. It is at this point that you will be able to know your cabin number and reservation number provided by the cruise line.

RESPONSIBILITY AND LIMITATION OF LIABILITY

Under these terms and conditions, liability to passengers for damage to or theft of luggage, personal property, delay, and circumstances onboard your cruise ship or elsewhere is limited. By booking the Aventura Dance Cruise, you (the passenger) agree to release and hold harmless Aventura Dance Cruise LLC, from and against any claim or cause of action arising out of or in connection with your travel on and participation in the Cruise, including, but not limited to: (1) injury, death or delay of passengers, or loss, damage or delay of or to passengers’ baggage or other property, which may be caused, directly or indirectly, in whole or in part, from participation in the Cruise, including, without limitation, passenger’s use of or participation in any shore excursion, onboard concession or athletic or recreational activity; ​(2) emotional distress, mental suffering or anguish or psychological injury of any kind under any circumstances (except when such damages were caused by U-Neek Events, LLC’s negligence and resulted from the same passenger’s sustaining actual physical injury, or having been at risk of actual physical injury, or when such damages are held to have been intentionally inflicted by U-Neek Events, LLC); (3) any change in scheduled Cruise events and/or celebrity appearances if any, musical band/group, DJ, performer/s; (4) the Cruise Line’s exercise of its contractual rights; or (5) or (if you are entering into this agreement on behalf of yourself and your, group, party, or traveling companions) any claim arising out of their assertion that you were not authorized to agree on their behalf. You further agree that Aventura Dance Cruise LLC shall not be held vicariously liable for the intentional or negligent acts of any persons not employed by U-Neek Events, LLC, nor for any intentional or negligent acts of U-Neek Events, LLC’s employees committed while off duty or outside the course and scope of their employment. If a court of competent jurisdiction holds any of the foregoing to be unenforceable, then U-Neek Events, LLC’s liability shall be limited to the maximum extent permitted by law. You will find onboard your cruise ship, independent concessionaires that operate shops, photography, gaming, etc. U-Neek Events, LLC accepts no responsibility whatsoever for the actions of these independent concessionaires arising from your dealing with them. You must contact and deal or interact with them directly. It is understood and acknowledged that U-Neek Events, LLC/U-Neek Sounds and the travel agency we use for travel arrangements is an outside, independent promoter and does not operate the vessel controlled and owned by the Cruise Line. In consideration of participating and attending the U-Neek Events, you voluntarily assume all risks while onboard the vessel and release U-Neek Events, LLC and the travel agency of and from any and all liability, actions, causes of action, suits, injury or death, loss or damage of property, claims, attorney’s fees and demands whatsoever that may be sustained by you while onboard the vessel. This release shall be binding upon you, and your heirs, next of kin, executors and personal representatives. Your decision to purchase and pay a deposit for this cruise private event constitutes your acknowledgment of and consent to all of the terms and conditions of the brochure and website, including the limitations of liability described in it.

DISPUTES

Except where prohibited by law, you (the passenger) expressly agree that: (1) any disputes, claims and causes of action arising out of or connected with the Cruise shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Jersey City, NJ, U.S.A. to the exclusion of the courts of any other state, territory or country; (2) you waive any venue or other objection that you may have to any such action or proceeding being brought in any court located in Jersey City, NJ; (3) any claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with the Cruise, but in no event attorneys’ fees; and (4) you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New Jersey, Hudson County, without giving effect to any choice of law or conflict of law rules (whether of the State of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New Jersey. You agree to present any claims against us within 30 days after the Cruise ends and to file within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. NEITHER PARTY MAY INITIATE OR BE PART OF A CLASS ACTION LAWSUIT OR LEGAL PROCEEDING AGAINST THE OTHER.

All trademarks are the exclusive property of their respective owners. The information contained on this page and in other pages and material relating to the Cruise, including any information regarding celebrity participation (if any) and programmed events, private events, musical band, performers, is subject to change at any time after notice. The details shown are for informational purposes only. The Released Parties are not responsible for any errors, changes and/or omissions resulting in pricing, inventory or content discrepancies.
Passenger acknowledges that a travel agency is being utilized by U-Neek Events, LLC/U-Neek Sounds in connection with the issuance of this ticket for all purposes. The travel agency shall not be liable for any representation made by said travel agency/agent. Passenger shall at all times remain liable to U-Neek Events, LLC/U-Neek Sounds for the price of passage.
In addition to the restrictions and exemptions from liability provided in these Terms and Conditions, U-Neek Events, LLC/U-Neek Sounds shall have the full benefit of any applicable laws providing for limitation and exoneration from liability, and nothing in contained herein is intended to operate to limit or deprive U-Neek Events, LLC/U-Neek Sounds of any such statutory limitation of or exoneration from liability. Without limiting the foregoing, U-Neek Events, LLC/U-Neek Sounds claim benefit of all restrictions, exemptions and limitations of the “Convention Relating to the Carriage of Passengers and Their Luggage by Sea” of 1974 as well as the Protocol to the “Convention Relating to the Carriage of Passengers and Their Luggage by Sea” of 1976 (“Athens Convention”), which limits liability for the death of or personal injury to a passenger to no more than the applicable amount of Special Drawing Rights as defined therein, and all other limits on damage or loss to personal property.
These Terms and Conditions contain the entire agreement between U-Neek Events, LLC/U-Neek Sounds, and Passenger and supersede any other agreements, written or oral, relating to the subject matter herein. Any waiver of any provision must be made in writing and signed by an authorized representative of U-Neek Events, LLC or U-Neek Sounds Entertainment. If any portion of shall be determined to be invalid, then said portion shall be deemed severed from the Contract in such jurisdiction only and all remaining portions shall remain in full force and effect.
